La prueba se utiliza para negar la admisión a los Estados Unidos o rechazar una solicitud de residencia legal permanente (una "tarjeta verde"). Las decisiones judiciales significan que para los inmigrantes que buscan tarjetas verdes en los EE. UU., Se aplican las viejas reglas: pueden seguir usando Medi-Cal / Medicaid, CalFresh / cupones de alimentos y programas federales de vivienda que ayudan a sus familias a mantenerse saludables. Y los miembros de la familia pueden continuar recibiendo beneficios en efectivo sin afectar la solicitud de tarjeta verde de un familiar a menos que los beneficios sean el único ingreso de la familia.

]]><![CDATA[Public Cahrge Update]]>Wed, 08 Jan 2020 20:50:36 GMThttps://www.thelibreproject.org/news-noticias/public-cahrge-updateOn January 8, 2020, the U.S. Court of Appeals for the Second Circuit decided to keep blocking the implementation of the Department of Homeland Security (DHS) changes to the “public charge” test.  The test is used to deny admission to the United States or refuse an application for lawful permanent resident status (a “green card”).  The court rulings mean that for immigrants seeking green cards in the U.S., the old rules apply-- they can keep using Medi-Cal/Medicaid, CalFresh/food stamps, and federal housing programs that help their families stay healthy.  And family members can continue to receive cash benefits without affecting a relative’s green card application unless the benefits are the family’s only income.
The court ruling does not affect the public charge decisions made by the Department of State (DOS).  People applying for a green card through a U.S. consulate face a different rule, which is in the process of changing.  Those who expect to apply for a visa or have their green card interviews outside the U.S. should consult an immigration lawyer.

]]><![CDATA[DEMANDAS PRESENTADAS EN CONTRA DE CAMBIO DE REGLA DE CARGA PUBLICA]]>Fri, 16 Aug 2019 18:41:08 GMThttps://www.thelibreproject.org/news-noticias/demandas-presentadas-en-contra-de-cambio-de-regla-de-carga-publicaEsta mañana, el National Immigration Law Center, el National Health Law Program, el Western Center on Law & Poverty y Asian Americans Advancing Justice-Los Angeles presentaron una demanda contra la Administración Trump para bloquear la implementación de la regla final del DHS, que amenaza a millones de familias inmigrantes - desproporcionadamente familias de color. La demanda, presentada en el Distrito Norte de California, fue presentada en nombre de organizaciones sin fines de lucro que sirven a las comunidades de inmigrantes y aboga por la equidad racial, la salud, los niños, los trabajadores agrícolas y las familias trabajadoras en la actualidad. La Clínica de la Raza et. al. v. Trump et al. presentada en el Tribunal de Distrito de los Estados Unidos para el Distrito Norte de California, le pide al tribunal que declare que el reglamento emitido por el DHS es ilegal e inconstitucional.

Como ya sabrán, trece estados encabezados por el fiscal general de Washington Robert Ferguson presentaron una demanda el miércoles, así como los condados de San Francisco y Santa Clara, para desafiar la regla también.

]]><![CDATA[LAWSUITS FILED OPPOSING PUBLIC CHARGE RULE CHANGES]]>Fri, 16 Aug 2019 18:36:57 GMThttps://www.thelibreproject.org/news-noticias/lawsuits-filed-opposing-public-charge-rule-changes​This morning, the National Immigration Law Center, National Health Law Program, Western Center on Law & Poverty, and Asian Americans Advancing Justice-Los Angeles filed a lawsuit against the Trump Administration to block the implementation of the DHS final rule, which threatens millions of immigrant families —disproportionately families of color. . The suit, filed in the Northern District of California, was filed on behalf of nonprofits serving immigrant communities and advocates for racial equity, health, children, farm workers, and working families today. La Clínica de la Raza et al. v. Trump et al. filed in the U.S. District Court for the Northern District of California, asks the court to declare the regulation issued by DHS unlawful and unconstitutional.
 
In addition to La Clínica de la Raza, the suit was brought by African Communities Together, the California Primary Care Association, the Central American Resource Center, the Council on American Islamic Relations -California, Farmworker Justice, the Korean Resource Center, the Legal Aid Society of San Mateo County, and Maternal and Child Health Access.
 
As you may already know, thirteen states led by Washington Attorney General Robert Ferguson filed a lawsuit Wednesday, as well as the Counties of San Francisco and Santa Clara, to challenge the rule as well.

​El Departamento de Seguridad Nacional anunció hoy que va a cambiar oficialmente la política de "Carga Pública" que existe desde hace mucho la cual afecta a las personas que solicitan tarjetas de residencia en los E.E.U.U.. Gracias a cientos de miles de comentarios públicos, la regla final no cuenta el uso de Medi-Cal por niños menores de 21 años o las mujeres embarazadas o el uso de los subsidios de Medicare Parte D en la determinación de carga pública. La regla también no afecta a los inmigrantes que solicitan programas de ayuda humanitaria (asilo, visas U, visa T, Estado Especial de Inmigrante Juvenil, etc.) o la gente que consigue Medi-Cal de emergencia o financiado por el gobierno (aparte de la atención a largo plazo) . Sin embargo, la regla final todavía dificulta la inmigración de familias de ingresos bajos y moderados, lo que perjudica a los inmigrantes, sus familias y nuestras comunidades.. “Department of Homeland Security announced today that it will officially change the longstanding “#PublicCharge” policy that affects people applying for green cards in the U.S. Thanks to hundreds of thousands of public comments, the final rule does not count the use of Medi-Cal by children under 21 or pregnant women or the use of Medicare Part D subsidies in the public charge determination. The rule also does NOT affect immigrants applying for humanitarian relief programs (Asylum, U-visas, T-visas, Special Immigrant Juvenile, etc.) or people getting Emergency-only or state-funded Medi-Cal (other than for long-term care). However, the final rule still makes it harder for low and moderate-income families to immigrate, which harms immigrants, their families, and our communities. El letrero a continuación revela que "a partir de enero de 2019, los representantes de ICE pueden llamarle al número de teléfono proporcionado a ICE" para realizar una encuesta de 30 minutos. The sign below reveals that "starting in January 2019 representatives from ICE may call you on the phone number provided to ICE" to conduct a 30 minute survey. While the sign states that "your answers to the survey will not be used for any enforcement purposes," AILA National's ICE Liaison Committee recommends that each attorney discuss with their clients the potential risks of participation/non-participation in this voluntary survey, and that all parties make an individual determination depending on each client's specific facts and history. AILA is seeking more information from ICE on this development and will post updates if they become available.
